DIGITAL DIGNITY

Connectivity Program Terms of Service

These Terms of Service (“Terms” or “Agreement”) constitute a legally binding agreement between Digital Dignity (“Digital Dignity,” “we,” “us,” or “our”) and you (“Customer,” “you,” or “your”).

The service is marketed, sold, billed, and supported by Selectel, Inc DBA Selectel Wireless, your authorized Service Provider (“Service Provider”), which operates the program on Digital Dignity’s behalf under a written agreement with us and serves as your primary point of contact. The contractual relationship for this service is between you and Digital Dignity.

By purchasing or using the service, you agree to these Terms.

1. Service Overview

We provide wireless broadband internet service, including data plans, SIM cards, and related equipment.

Your Service Provider manages signup, billing, customer support, and equipment fulfillment on our behalf.

The service is delivered using the network of T-Mobile US, Inc. (“Carrier”). We do not own or control the Carrier’s network. The Carrier’s terms of service and privacy policy apply to your use of the service and are incorporated into these Terms by reference (available at t-mobile.com). Additional terms from our wholesale supply arrangement that enables this service also apply and are available from your Service Provider on request. If any conflict arises between these Terms and the Carrier’s terms, the Carrier’s terms control with respect to use of the Carrier’s network.

2. Eligibility

You must be at least 18 years old and located in the United States. The service is not available for use outside the United States.

By signing up, you confirm that you want affordable internet, have limited options, value privacy, or support the program’s mission. No documentation is required.

3. Equipment

Your Service Provider may provide equipment (router and SIM) or allow you to use a compatible device.

Equipment provided may remain the property of your Service Provider or Digital Dignity while your service is active. You must not tamper with or misuse the equipment and must return it if requested upon cancellation.

4. Acceptable Use

The service is for personal, residential use only.

You may not:

  • resell, share, or redistribute the service
  • use it for business or commercial purposes
  • use it for illegal, fraudulent, or harmful activity
  • interfere with the network or other users
  • violate the Carrier’s terms
  • use the service as a mobile hotspot on the road or to provide connectivity to other properties

You are responsible for all activity on your account and for keeping your account credentials secure.

5. Network and Performance

The service runs on the Carrier’s wireless network, which we do not control.

Because of this:

  • speeds, coverage, and uptime are not guaranteed
  • the Carrier may manage traffic, including deprioritization during congestion or throttling at high usage thresholds
  • heavy users may experience slower speeds
  • video streaming may be optimized to standard-definition quality

These are standard practices applied by the Carrier to all T-Mobile 5G home internet customers.

6. Billing and Payment

Your Service Provider handles billing, payments, and account management on our behalf.

You agree to pay all charges when due and maintain a valid payment method.

Missed payments may result in suspension or termination. Payments are non-refundable except where required by law.

7. Changes to Service

The service depends on the Carrier and other upstream providers who retain sole control over their networks, pricing, plan terms, coverage, speeds, data allowances, and availability. Any changes they make (“Carrier-Driven Changes”) are outside our control.

We may modify, suspend, or discontinue the service or any part of it at any time, including in response to Carrier-Driven Changes or for any other reason. Where a Carrier-Driven Change requires us to act quickly, we may make changes with little or no advance notice.

We are not liable for outages, interruptions, performance issues, Carrier-Driven Changes, or any adjustments we make in response.

8. Cancellation and Termination

You may cancel at any time by contacting your Service Provider.

We may suspend or terminate service for:

  • non-payment
  • violation of these Terms or the Carrier’s terms
  • misuse, fraud, or identity misrepresentation
  • Carrier or program requirements

Service ends upon termination, and any outstanding charges remain due. Serious violations may be referred to law enforcement.

9. Privacy

We collect only the information needed to provide and support the service.

We, your Service Provider, and the Carrier may monitor usage to enforce these Terms, protect the network, and comply with legal requirements.

10. Disclaimers and Liability

The service is provided “as is” and “as available” without warranties of any kind, express or implied.

Digital Dignity, your Service Provider, the Carrier, and our upstream suppliers are not liable for:

  • service interruptions or outages
  • lost data or profits
  • indirect, incidental, special, consequential, or punitive damages
  • Carrier-Driven Changes or adjustments made in response
  • network-related issues outside our control

Total aggregate liability for any claim is limited to the amount you paid in the month before the claim arose.

You agree to indemnify and hold harmless Digital Dignity, your Service Provider, the Carrier, our upstream suppliers, and their respective affiliates from any claims, damages, losses, or expenses arising from your use of the service, your violation of these Terms or the Carrier’s terms, your infringement of third-party rights, or your illegal or unauthorized activities.

11. Governing Law

These Terms are governed by New Jersey law, without regard to its conflict of laws rules. Any claim must be brought within one year of when it arose, or it is barred.

12. General

These Terms are the full agreement between you and Digital Dignity.

Digital Dignity, your Service Provider, the Carrier, and our upstream suppliers are third-party beneficiaries of applicable protections in these Terms and may enforce them directly.

We may update these Terms at any time. Continued use of the service means you accept the updates.

By using the service, you acknowledge you have read these Terms and agree to be bound.
